In a brand development process three fundamental questions arise: Why, how and where to register?
The registration of a trademark is, first of all, the obtaining of legal protection against abusive use by third parties and that also confers the right to use symbols that may dissuade the violation, such as ®.
As a first step, we analyze the availability of the name, trademark, or symbols registered at a national and international level, so that no application is made for registration with elements identical to other trademarks. We then check whether there is a domain available for registration with the brand name, always following standards and requirements per current legislation. The next step is to apply for registration with the competent authorities, and in Portugal, the institution responsible is the INPI (National Institute of Intellectual Property), while for the registration of community trademarks in the European Union is the EUIPO (European Union Intellectual Property Office). The international registration is through an application to the WIPO (World Intellectual Property Organization) institution.
